Below is a letter from Randy's friends, Alessia and Arturo - in both Italian and English - which they wrote to accompany the urgent appeal made by the Sant'Egidio Community.

Siamo una famiglia italiana che nel 2009, grazie a una persona a noi cara della Comunità di Sant’Egidio a Roma ha avuto la possibilità, di intraprendere un percorso epistolare di amicizia, che dura oramai da oltre 10 anni, con un condannato a morte negli Stati Uniti, con precisione in Texas, Nonostante fossimo a conoscenza dell’esistenza di numerosi penitenziari nel mondo denominati” Death Row”,( braccio della morte) non sapevamo tuttavia che fosse possibile poter interagire con le persone detenute al loro interno attraverso una normale corrispondenza, forse anche per quel senso di disagio e inquietudine che subentra al solo immaginare una realtà così lontana dalla nostra cultura.

La Comunità di Sant’Egidio ce ne ha parlato umanizzando il tema ai nostri occhi e decidemmo così di dare la nostra disponibilità. Ci furono indicati un nome, un indirizzo e poche informazioni in più. Ci colpì subito la sua data di nascita: uno di noi aveva la sua stessa età. Questo inizialmente ci bloccò. Saremmo stati mai in grado di comprendere e sopportare quel meccanismo così crudele e sprovvisto di pietà quale è la pena di morte? Passarono diversi giorni ma alla fine decidemmo di scrivere la nostra prima lettera. La ricordiamo ancora oggi con un sorriso per l’emozione e per l’incapacità, forse, di scrivere in quel momento qualcosa di sensato a una persona completamente sconosciuta. Ricevemmo la risposta di Randy nello stesso mese e, come avrete già intuito, non abbiamo più smesso di scriverci. Passarono i mesi e con molta delicatezza cominciammo a fare qualche domanda sulla sua situazione: avevamo già raccolto diverse informazioni su di lui attraverso internet ma...mancavano le sue parole.

Ci aprì il suo cuore con molta onestà. Avevamo incominciato a conoscerlo come “Persona” e in quel preciso istante capimmo che non l’avremmo mai abbandonato. Siamo contrari da sempre alla pena di morte e fin dall’inizio della nostra esperienza abbiamo approfondito queste tematiche leggendo articoli e libri, coltivando la riflessione secondo cui la giustizia che uccide smette di essere giustizia. Possiamo partire dalle motivazioni più ovvie che ci spingono a giudicare l’assassinio legale come un atto lontano dalla dichiarazione universale dei diritti umani, adottata dall’Assemblea Generale delle Nazioni Unite nel dicembre del 1948. Condannare a morte una persona moltiplica solo la sofferenza. Allo strazio dei familiari della vittima si sommerà il dolore dei parenti e degli amici del giustiziato, e fornirà l’effimera illusione che, nella vendetta sul presunto colpevole, ci sarà la guarigione dal loro dolore e dall’odio. Nella realtà, l’esecuzione comporta la privazione della vita per impedire ai detenuti di commettere crimini che molti di loro non avrebbero comunque commesso. Proprio come nel caso di Randy. Per quanto può valere, possiamo dirvi senza alcun dubbio che Randy è una persona sensibile, spiccatamente altruista e con un desiderio costante: non deludere nessuno. Considerando, però, ciò che è accaduto 19 anni fa, pensiamo anche che la sua ingenuità abbia contribuito a condurre alla dolorosa condizione in cui oggi si trova. Non sarebbe mai stato in grado di organizzare nessuna fuga e tantomeno un omicidio perché non è nella sua natura. Chiediamo per Randy un processo equo e imparziale, perché questo è un diritto costituzionale, anche negli Stati Uniti, anche in Texas. Randy dovrebbe essere ritenuto responsabile solo per il suo ruolo durante la rapina e non dovrebbe essere condannato per le azioni e i crimini altrui. È scappato di prigione e ha preso parte alle rapine, ma NON è un assassino!

In Texas dal 1974 è in vigore la Law of Parties, legge secondo la quale tutti i membri di un gruppo che commette un reato, vengono giudicati ugualmente colpevoli. Ciò significa che se un membro del gruppo commette un omicidio, tutti verranno condannati per omicidio.

È importante ricordare però che nel 1974, NON era ancora stata introdotta la pena di morte nello Stato.

Solo questo dovrebbe già dare il diritto a un processo molto più scrupoloso e assolutamente imparziale perché già minato da una legge altamente discutibile.

Nel 2021 la Law Of Party sarà probabilmente ridiscussa perché è evidente come, applicata a casi di omicidio, determini un clamoroso squilibrio delle pene, rendendola ingiusta e iniqua. Ora però non possiamo rassegnarci a questa ingiustizia: Randy, che non ha mai usato un’arma, vive da sedici anni nel braccio della morte, privato dei diritti civili e soggetto a pesanti restrizioni. Randy ha una miriade di prove a sostegno della propria innocenza, ma alla giuria non è stato permesso vedere alcuni documenti, né conoscere gran parte delle prove a suo favore. Non è necessario ricordare la gravità dei pensieri e delle azioni del giudice Cunningham, basta guardare i giornali più importanti di tutto il mondo. È semplicemente un orrore, un degrado morale inaudito, soprattutto perché siamo nel 21 ° secolo, e soprattutto perché riguarda un tribunale in cui si decide il destino delle persone.

Questa è un'orribile ingiustizia, una derisione della Costituzione e dei Diritti Umani.

È stata l'inattività di coloro che avrebbero potuto agire; l'indifferenza di coloro che avrebbero dovuto conoscere più di altri; il silenzio delle voci quando erano più importanti; ciò che ha reso possibile questa mostruosità!

Avere un processo equo, imparziale e trasparente non è solo un diritto costituzionale per Randy Halprin, ma è anche un dovere da parte dello stato, in rispetto di tutte le Famiglie coinvolte. TUTTA la vita è preziosa! Questa dovrebbe essere una credenza ampiamente diffusa in qualsiasi sistema giudiziario, specialmente nei confronti di un uomo INNOCENTE.

Halprin sarà ucciso nella Giornata Mondiale Contro la Pena di Morte. Un altro immenso dolore, non solo perché è un uomo innocente dell’accusa di omicidio, ma anche perché è un altro insulto che il Texas fa a un diritto universale, quello della Vita.

Nessuno di noi può cambiare una legge, ma ciascuno di noi può esprimere la propria opinione. Non pretendiamo l’assoluzione per Randy, ma che i tribunali concedano un nuovo processo e che abbia salva la vita non avendo mai premeditato ne commesso alcun omicidio. Deve poter dimostrare tutto questo davanti a un giudice che non sia razzista e antisemita.

E’ questo il momento per agire, prima del 10 ottobre che potrebbe essere la data di esecuzione di un uomo che non è un assassino, che è ebreo, che ha subito crudeltà da bambino e che merita, senza alcun dubbio di vivere. Grazie.

We are an Italian family that in 2009, thanks to a person dear to us from the Community of Sant'Egidio in Rome, had the opportunity to undertake an epistolary journey of friendship, which has lasted for over 10 years now, with a person sentenced to death in the United States with precision in Texas. Although we were aware of the existence of numerous penitentiaries in the world called “Death Row,” we did not know however that it was possible to interact with the people detained within them through a normal correspondence, perhaps also because of that sense of unease and restlessness that takes over only imagining a reality so far from our culture.

The Community of Sant Egidio talked about humanizing the theme in our eyes and we decided to give our availability. We were given a name, an address, and a little more information. His date of birth struck us immediately: one of us was his age. This initially blocked us. Would we ever have been able to understand and endure that mechanism so cruel and devoid of pity which is the death penalty? Several days passed but in the end we decided to write our first letter. We still remember today with a smile for the emotion and for the inability, perhaps, to write at that moment something sensible to a completely unknown person. We received Randy's reply in the same month and, as you may have already guessed, we never stopped writing to each other. Months passed and very gently we began to ask some questions about his situation: we had already collected various information about him through the internet but ... his words were missing.

He opened his heart to us with great honesty. We had begun to know him as a "Person" and at that precise moment we realized that we would never abandon him. We have always been opposed to the death penalty and from the beginning of our experience we have studied these issues in depth by reading articles and books, cultivating the reflection that the justice that kills stops being justice. We can start from the most obvious motivations that push us to judge the legal assassination as an act far from the universal declaration of human rights, adopted by the General Assembly of the United Nations in December 1948. To condemn to death a person multiplies only suffering. Adding to the agony of the victim's relatives will be the pain of relatives and friends of the executed, and will provide the ephemeral illusion that, in revenge on the alleged culprit, there will be healing from their pain and hatred. In reality, execution involves deprivation of life to prevent inmates from committing crimes that many of them would not have committed anyway. Just like in the case of Randy. For what it's worth, we can tell you without a doubt that Randy is a sensitive, distinctly unselfish person with a constant desire: not to disappoint anyone. Considering, however, what happened 19 years ago, we also think that his naivety has contributed to lead to the painful condition in which he finds himself today. He would never have been able to organize any escape, let alone murder because it is not in his nature. We ask for Randy a fair and impartial process, because this is a constitutional right, even in the United States, even in Texas. Randy should only be held accountable for his role during the robbery and should not be condemned for the actions and crimes of others. He escaped from prison and took part in the robberies, but he is NOT a murderer!

In Texas, the Law of Parties has been in force since 1974, a law according to which all members of a group who commit a crime are deemed equally guilty. This means that if a member of the group commits a murder, everyone will be convicted of murder.

It is important to remember, however, that in 1974, the death penalty had NOT yet been introduced in the State.

Only this should already give the right to a much more scrupulous and completely impartial process because it is already undermined by a highly questionable law.

In 2021 the Law Of Party will probably be re-discussed because it is evident how, applied to cases of murder, it causes a sensational imbalance of the penalties, making it unfair and unjust. Now, however, we cannot resign ourselves to this injustice: Randy, who has never used a weapon, has been living on death row for sixteen years, deprived of civil rights and subject to heavy restrictions. Randy has a myriad of evidence in support of his innocence, but the jury was not allowed to see some documents, nor know much of the evidence in his favor. It is not necessary to remember the gravity of the thoughts and actions of Judge Cunningham, just look at the most important newspapers from all over the world. It is simply a horror, an unheard of moral degradation, above all because we are in the 21st century, and above all because it concerns a court in which the fate of people is decided.

This is a horrible injustice, a mockery of the Constitution and Human Rights.

It was the inactivity of those who could have acted; the indifference of those who should have known more than others; the silence of the voices when they were more important; what made this monstrosity possible!

Having a fair, impartial and transparent process is not just a constitutional right for Randy Halprin, but it is also a duty on the part of the state, in respect of all the families involved. ALL life is precious! This should be a widely held belief in any judicial system, especially against an INNOCENT man.

Halprin will be killed on World Day Against the Death Penalty. Another immense pain, not only because he is an innocent man of the murder charge, but also because it is another insult that Texas makes to a universal right, that of Life.

None of us can change a law, but each of us can express our opinion. We do not claim the acquittal for Randy, but that the courts grant a new trial and that his life is saved by never having committed any murder. He must be able to demonstrate all this before a judge who is not racist and anti-Semitic.

This is the time to act, before October 10th, which could be the execution date of a man who is not a murderer, who is Jewish, who has suffered cruelty as a child and who deserves, without any doubt of living. Thanks.
